Terms and Conditions
Orders
All orders placed through this web site are subject to confirmation and acceptance by Sound Business Systems (SBS). SBS reserves the right to restrict sales to retail quantities when supplying resellers and distributors.
For each online order, you must pay:
- The applicable price for the relevant goods; and
- The delivery and handling fee.
Prices and availability are subject to change without notice.
Privacy
The Sound Business Systems Privacy statement specifies what kind of information the company gathers from the site and what measures are taken to protect your personal information.
General
While we do not generally require that you provide us with personally identifiable information, such as your e-mail address, name, mailing address, telephone number, credit card number etc., (together "Personal Data"), in order to visit and use this web-site, and any sub-sites thereof, (together "the Site"), published and maintained by SBS (with main office address Level 11, 94 Dixon St, Wellington, New Zealand), please note that in order to take part in some of our functions and activities and to get access to some of our products or services, it will be necessary for you to provide Personal Data on certain areas of the Site.
By providing any Personal Data to us on the Site, you fully understand and unambiguously consent to collection, use, and transfer of such Personal Data on the terms and conditions outlined in this privacy notice. If you do not agree to these Terms of Privacy, do not provide Personal Data to us on the Site. Moreover, we reserve the right to change or modify the Terms of Privacy at any time as posted, following for example changes in applicable legislation.
Collection of Personal Data and other user information
Sound Business Systems will only collect Personal Data on a mandatory basis where it is necessary for us to carry out one or more of requested functions or activities, or for you to get access to our products or services, and we will only collect it by lawful and fair means. Sound Business Systems might request additional non-mandatory information from you in order to improve its knowledge of its customers or to conduct direct marketing or invite you to contests. You are free to respond to any such requests for additional information.
Use and Disclosure of Personal Data
The Personal Data provided to us on the Site will be handled in appropriate and considerate manners. Without limiting the foregoing we will use the Personal Data for the purpose of the requested function or activities, for you to get access to our products or services in question, or for a purpose specifically stated on the relevant area of the Site.
Sound Business Systems always reserves the right to use and disclose Personal Data for the purpose of conducting direct marketing. Furthermore, Sound Business Systems may combine the Personal Data you provide on the Site with other information we may collect from you or from third parties in order to more effectively tailor the Site, functions, activities, products, services, and offerings to you.
Destruction and up-date of Personal Data
Should the Personal Data held by us no longer be required by us for any purpose, we undertake to take reasonable steps to destroy or de-identify the Personal Data after a reasonable period of time has elapsed.
If you provide Sound Business Systems with Personal Data, you shall have the right, on reasonable prior written notice, to request inspection, change, amendment, or deletion of such Personal Data. Instructions on how to request inspection change, amendment, or deletion of your Personal Data will be provided upon request.
Transfer of Personal Data
Sound Business Systems will not transfer the Personal Data you provide on the Site to any third party, except (a) with your consent; (b) as may be required by law or court order.
Security
While Sound Business Systems cannot guarantee that unauthorised access will never occur, rest assured that we take great care in maintaining the security of your Personal Data and in preventing unauthorised access to it through the use of appropriate technology and internal procedures.
Errors or Omissions
Sound Business Systems is entitled at any time to correct all errors and omissions (whether clerical, computational or otherwise) in any advertising, quotation, invoice or acknowledgement. Sound Business Systems will notify the buyer promptly of any error or omissions discovered, and give the buyer the option of returning the goods for a full refund.
Shipping
Sound Business Systems will make every effort to ensure delivery of goods or performance of services is on time but will not be liable to you for any loss or damage arising in any way from any delay in delivery or performance.
Where the goods are not immediately available you will be notified of this by Sound Business Systems as soon as possible.
All claims for shortage or damage during delivery must be made to the carrier within seven days of the date of delivery.
Once the goods have been delivered to the designated delivery address, the purchaser will accept responsibility if they are lost or damaged.
Refunds
Sound Business Systems offer a 7 day return policy for products returned in their original, unopened and undamaged packaging except any products sold on a no return basis.
A credit will be issued for the original purchase price of the product, less:
- Any associated freight costs and
- A re-stocking fee of 10% of the purchase price
Only products that are faulty or otherwise returnable under a statutory warranty, or a manufacturer's warranty will be accepted for return after 7 days. Freight costs will be factored in or waived accordingly.
Warranties
Goods are subject to the manufacturers' warranties only. Sound Business Systems will pass on the benefit of those warranties to you, without itself being directly liable to you under any warranty.
Any warranty may be voided by damage to or misuse of the system, problems caused by the use or misuse of software, negligent installation or operation, inadequate packaging, cleaning or maintenance, unauthorised repairs, modifications or the addition of incompatible hardware.
Returns
We will need the following information, before we can issue you with a Return Authorisation (RA) Number:
Name and contact details
Invoice Number or Order Number
Item Serial Number(s)
Reason for return
RA numbers are only valid for 14 days, so we must receive the returned product within this period, or you will require a new RA number.
Please ensure that all products are suitably packaged in order to prevent damage during return shipping. We will not accept responsibility for goods, which are damaged whilst in transit back to us.
Sound Business Systems are not responsible for freight charges for stock being returned.
Please do not write on or attach labels to the product being returned; otherwise, the return may not be accepted, as it will be deemed damaged.
A copy of the original invoice, or other proof of purchase must be included with the returned product. The Return Authorisation Number should be clearly visible on the outside of the shipping carton and addressed to the following address (unless otherwise directed):

Liability
Any liability of Sound Business Systems in connection with goods or services supplied to you will, subject to any non-excludable liability for breach of conditions or warranties implied by legislation and to the maximum extent permitted by law, at the election of Sound Business Systems be limited to:
- - In relation to goods, the replacement of the goods or the supply of equivalent goods; and
- - In relation to services, the supplying of the services again or the payment of the cost of having the services supplied again.
Changes To Terms
Each order is governed by the terms and conditions current when the order is placed. Sound Business Systems may add to, delete or otherwise change these terms and conditions without notice. It is your responsibility to read and understand these terms and conditions each time you place an order.
Consumer Guarantees Act 1993
If you are purchasing or holding yourself out as purchasing the Products for a business purpose, then the provisions of the Consumer Guarantees Act 1993 (New Zealand) are excluded from any supply agreement and to the extent permitted by law, all statutory or implied conditions, warranties and guarantees which would apply are expressly excluded.
Payment and Title
Payment shall be made by one of the following options: direct credit, cheque, or credit card. The customer will select their payment option during the ordering process.
Unless we have agreed to extend credit to you, payment is to be made before supply. Payment by cheque or by any type of bank transfer will not be considered payment until the payment has been fully cleared through the banking system into our bank account.
Purchase orders are accepted at our discretion.
Should payment for supply of goods or services be outside of, or beyond, our payment terms, you will be liable for all costs, fees, damages, and expenses including legal costs (on a full indemnity basis) and all other fees incurred by us in recovering the amount outstanding. Ownership of the goods remains with us and does not pass to you until we receive all amounts you owe to us.
Waiver
If we fail to enforce any terms or to exercise our rights under these terms and conditions at any time, we have not waived those rights.
Governing Law
These terms and conditions are governed by, and shall be construed in accordance with, the laws of New Zealand.
